Terms of Service

1. Acceptance of Terms

By accessing or using Impectly ("the Service"), operated by Impectly ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Impectly is an AI-powered startup discovery and competitor analysis platform. The Service provides access to startup revenue data, SEO intelligence, market analysis, and AI-assisted research tools. Data is sourced from publicly available information and third-party providers.

3. Accounts and Registration

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Credits

The Service offers free and paid subscription plans. Paid plans are billed monthly and provide a set number of credits per billing cycle. Credits are consumed when you send messages to the AI assistant (1 message = 1 credit).

• Free Plan: 10 credits per month
• Builder Plan: 150 credits per month ($19/mo)
• Founder Plan: 500 credits per month ($49/mo)

Unused credits do not roll over to the next billing cycle. Credits reset on your monthly billing date.

5. Refund Policy

5.1 Eligibility

You may request a refund within 7 days of your purchase date, provided that you have used fewer than 20 credits from your subscription.

5.2 Non-Refundable

Refunds will not be issued in the following cases:

• More than 7 days have passed since the purchase date
• You have used 20 or more credits from your current subscription
• Your account has been suspended or terminated for violating these Terms
• You have previously received a refund for the same subscription type

5.3 Right to Decline

We reserve the right to decline any refund request at our sole discretion, including in cases where we suspect abuse of the refund policy or fraudulent activity.

5.4 Processing

Approved refunds are processed within 5-10 business days and returned to the original payment method. Upon refund, your account will be downgraded to the Free plan and your credits will be reset to zero immediately.

5.5 How to Request

To request a refund, contact us at support@impectly.ai with your account email and reason for the refund.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to extract, scrape, or systematically download data from the Service
• Share your account credentials with third parties
• Circumvent rate limits or credit restrictions
• Use automated tools or bots to interact with the Service
• Reverse engineer or attempt to extract the AI system prompts
• Resell or redistribute data obtained from the Service

7. Data Accuracy

While we strive to provide accurate startup and market data, we do not guarantee the accuracy, completeness, or timeliness of any information provided through the Service. AI-generated analysis should not be the sole basis for business or investment decisions. Always verify critical data independently.

8. Intellectual Property

The Service, including its design, features, and content, is owned by Impectly and protected by intellectual property laws. You retain ownership of your queries and any original content you create. AI-generated responses are provided for your use but may not be exclusively unique to you.

9. Limitation of Liability

To the maximum extent permitted by law, Impectly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or other intangible losses resulting from your use of the Service.

10. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Any unused credits are forfeited upon termination.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.
